Credit Card Lawsuit Defense and Debt Settlement

If you are sued by a credit card company, there are some defenses that can help you limit the company’s recovery. To establish the lawsuit, the credit card company or debt collector must serve you with a Summons, and you are required to respond to the Summons within a designated timeframe. However, there may be defenses available for you.

If you are facing a lawsuit against a credit card company, the Law Offices of Anthony S. Hamassian will represent you in defending against the credit card company to help you achieve successful results. If you are in debt and would like to settle your claims, the Law Offices of Anthony S. • Renter’s Insurance

The Law Offices of Anthony S. Hamassian also represents clients in actions involving bad faith and misrepresentation claims. It is highly important that you seek legal representation should you be faced with a denial of coverage so that you are able to explore all your legal options prior to making a decision that may affect your claim.

Misappropriation of Name, Image and Likeliness

A party is liable for invasion of privacy if s/he engages in misappropriation of name, image and likeliness, that is, using the name or likeness of another for commercial purposes without permission. One example of this is using the name or photograph of a celebrity without consent in an advertisement or other marketing or promotional activity. Consent to use a person’s name or likeliness for commercial purposes should always be given in writing.

The Law Offices of Anthony S. Hamassian represents both plaintiff and defendants in cases involving misappropriation of name, image, and likeliness and will protect its clients’ rights to the fullest extent under the law.

Defamation

Defamation is an umbrella term for any statement that injures a person’s reputation. In its written form, defamation is referred to as “libel”, whereas in its oral form, defamation is referred to as “slander”. Defamation is not a criminal act, but rather a civil wrongdoing, or a “tort”. A party who has been the subject of defamation can sue the party who made the defamatory statement.

The Law Offices of Anthony S. Hamassian represents both plaintiffs and defendants in cases involving defamation and will protect its clients’ rights to the fullest extent under the law.

Mediation

Many cases do not get to trial, but rather are settled through a process called mediation. Mediation is a less expensive alternative to settle a lawsuit in which an unbiased third party hears all sides of the case and works to resolve the issues outside of the courtroom.

Civil (non-criminal) cases are the most common cases that are mediated, including, but not limited to: cases involving contracts, employment, and other disputes amongst parties. Unlike presenting a case in the courtroom, mediation can work out all conflicting issues of the case, not just the issue(s) precipitating the lawsuit.

The Law Offices of Anthony S. Hamassian represents its clients vigorously throughout the mediation process. We understand the financial and emotional effects of a civil lawsuit; that is why mediation is highly beneficial; both to resolve the lawsuit quickly and to save clients the cost of litigation.

Arbitration

Similar to mediation, arbitration is a neutral, confidential and inexpensive alternative to presenting a dispute in the courtroom. Arbitration is consensual by all parties, and the parties work together to select an arbitrator.

Each party to the arbitration presents its evidence to the arbitrator. The arbitrator then carefully reviews all relevant information, issues and evidence and issues a decision, or an “award”. In order for the arbitrator’s decision to be legally enforceable, it must be confirmed by the court. The losing party can seek to have the court vacate the award.

For the same reasons as to why mediation is important, the Law Offices of Anthony S. Hamassian represents its clients vigorously throughout the arbitration process. We understand the financial and emotional effects of a civil lawsuit; that is why arbitration is highly beneficial; both to resolve the lawsuit quickly and to save clients the cost of litigation.
